You found the right car, the price works and you are ready to sign. Before you drive off the lot, there is one more piece to line up: car insurance. In Texas, you need proof of liability coverage to legally drive and to register a vehicle, and if you finance, your lender will ask for more than the state minimum. Here is what San Antonio used-car buyers should know before buying.
Texas Minimum Liability Coverage: 30/60/25
Under Texas Transportation Code Chapter 601, a basic liability policy must cover at least:
- $30,000 for bodily injury to or death of one person in a crash
- $60,000 for bodily injury to or death of two or more people in one crash
- $25,000 for damage to or destruction of other people’s property
This is often written as “30/60/25.” Liability pays for damage you cause to others. It does not pay to fix your own car. Bills to the Legislature in 2025 proposed raising these minimums, but they did not pass, so 30/60/25 remains the requirement.
Other Coverages You Will Be Offered
The Texas Department of Insurance (TDI) auto insurance guide explains the main coverage types. A few that matter most for used-car buyers:
- Personal injury protection (PIP): Helps pay medical bills and lost income for you and your passengers, no matter who caused the crash. Texas insurers must include it unless you reject it in writing.
- Uninsured/underinsured motorist (UM/UIM): Protects you if the other driver has no insurance or not enough. It must also be offered, and you must reject it in writing if you do not want it.
- Collision: Pays to repair your car after a crash, minus your deductible.
- Comprehensive: Covers theft, hail, flooding, fire, vandalism and hitting an animal, minus your deductible. In South Texas, hail and flood are real risks.
If You Finance, Your Lender Will Require Full Coverage
When you owe money on a car, the lender has a stake in it. According to TDI, lenders require you to carry collision and comprehensive until the loan is paid off. If you drop that coverage, the lender can buy a policy that protects only its interest and add the cost to your loan, and that coverage is usually expensive and does not protect you.
TDI also notes that dealers and lenders may offer gap insurance, which can pay the difference if your car is totaled or stolen and you owe more on the loan than the car is worth. It is optional, so ask what it costs and compare it with what your own insurer charges.
At Trilux Motors, same-day financing is available with approved credit. As an example, our payment estimates are based on 48 months at 15.09% APR with $500 down (example only; down payment is set by the lender and varies with approved credit). Your actual terms depend on your credit and the vehicle.
Already Insured? You May Have a Short Grace Period
If you already have a Texas auto policy, TDI says a newly acquired car is generally covered automatically for about 20 days. If it is an added car, it usually gets the highest coverage on your policy; if it replaces a car, it gets the same coverage as the car it replaced. Do not rely on the grace period: call your agent before or right after you buy, give them the VIN and confirm the car is added. Lenders typically want proof of the required coverage before you leave with a financed car.
What Counts as Proof of Insurance in Texas
Texas law lets you show proof of financial responsibility in several ways, including:
- The insurance card from your insurer
- An image of your proof of insurance on your phone or another electronic device
- A copy of the policy or an insurance binder
Keep proof in the car or on your phone. You will need it if you are pulled over, after a crash and when you register or renew your registration.
TexasSure: How Officers and Tax Offices Check Your Coverage
TexasSure is the state’s insurance verification database. Law enforcement and county tax offices use it to confirm that a vehicle is insured. According to the TexasSure FAQ, insurers report policy information weekly, and a new or changed policy can take about three weeks to show up. Mismatched details, such as a misspelled name or wrong VIN, can make an insured car appear uninsured.
Tip: Check that the VIN on your insurance card matches the VIN on the car and your title paperwork exactly. And keep your own proof handy during those first weeks, since the database may not show your new policy yet.
Penalties for Driving Without Insurance
Chapter 601 sets real consequences for driving uninsured in Texas:
- First offense: a fine of $175 to $350, plus court costs
- Later offenses: a fine of $350 to $1,000
- After a second conviction, your driver’s license can be suspended unless you file proof of future financial responsibility, and the vehicle can be impounded for up to 180 days, with storage fees you pay
And if you cause a crash without insurance, you can be personally responsible for the other driver’s damages.
Smart Steps Before You Buy
- Get quotes early. Once you narrow it to one or two cars, get quotes with each VIN. Rates depend on the vehicle, your driving record, your ZIP code and other factors.
- Ask your lender what is required. Know the maximum deductible they allow before you pick a policy.
- Compare deductibles. A higher deductible lowers your premium but means more out of pocket after a claim.
- Ask about discounts. TDI lists common ones, such as bundling, safe driving and defensive driving courses.
- Driving to Mexico? TDI warns that Mexico does not recognize U.S. auto policies, so you will need a Mexican liability policy.
